This file against Agustín Leal was opened due to, according to the Interior, “the principle of political neutrality of the Civil Guard.” This decision was appealed and suspended by decision of the Central Military Court, according to close sources, who also assure that this first file “is still in progress and it may take up to six months for the instructor to close it, whether or not to transfer a proposed sanction.
Jucil pointed out to the then recently appointed general director of Benemérita, Leonardo Marcos, as the person responsible for this legal offensive against the Benemérita association by the Ministry of the Interior of Fernando Grande-Marlaska. «He wants us quiet and afraidbecause we are the association that most demands respect for the rights of the civil guards,” they denounced.

In November, in addition to Agustín Leal, two members of another professional association of the Civil Guard, APROGC, were charged under the same conditions by the Ministry of the Interior of Marlaska, for a statement in which they recalled their oath as soldiers and said they were willing to “shed his blood” in defense of Spain and the Constitution.
