This Tuesday, the Senate Board will give the go-ahead to process the proposed organic amnesty law and will choose to have it done through the ordinary procedure, as requested by the PP, which has a majority in the Chamber, without the urgency with which it is processed in Congress. The meeting of the Board will begin at 12:00 and is the first since the initiative was registered in the Upper House on Friday after its approval by the plenary session of Congress on Thursday by 178 votes in favor and 172 against.
At this meeting, therefore, the Board has to qualify the bill and admit it for processing. Vox has warned of a possible complaint against the Senate Board if it decides to process it and not support its proposal to raise a conflict of interest with Congress before the Constitutional Court. Previously, however, and in response to Vox's demands, the Board already commissioned a report from the lawyers so that they could ratify the obligation it has to follow through on a proposal approved by Congress. In the report, the lawyers believe that the Upper House should admit the proposal for processing, since it is an “automatic obligation” according to article 90.1 of the Constitution. In another report, however, the lawyers emphasize that the law that has reached the Senate is unconstitutional and propose that the text continue “purging unresolved unconstitutionality defects” during its passage through Congress. In addition, they recommend that the processing be carried out by a joint commission of 32 senators, made up of members of two already established commissions: the Constitutional and the Justice.
All of these reports will be on the table of the governing body of the Senate. The report that has not yet been received is the one requested from the General Council of the Judiciary, whose plenary session has to decide this Thursday, the 21st, between those drafted by two of its members, one in favor of the constitutionality of the amnesty and another in against.
Regarding the decision on the procedure for processing, the Board, in all probability, will choose the ordinary one, which authorizes the Upper House to process it until May 16 for two months from its registration, instead of the urgent one. , which would make it 15 days.
In addition, the President of the Government, Pedro Sánchez, chairs the meeting of the Council of Ministers.
This Tuesday's news also includes the Basque and Catalan elections, which continue to set the political agenda.
