The Santander Juvenile Court has sentenced four minors, their parents and a school in Santander for a case of bullying at that educational center. Together, they must compensate the student who suffered physical and psychological attacks with 4,000 euros.
In addition, the schoolchildren will have to carry out socio-educational tasks for 10 months for a crime against moral integrity, according to the sentence, handed down after the agreement reached with the prosecutor who has investigated this case, to which he had access this Thursday. According to the resolution, it has been proven that the four minors in question, all of them acting in common agreement and with the purpose of “seriously undermining the moral integrity” of the victim, carried out different acts aimed at that end, in a “continuous” manner. and practically every day†, for almost a full academic year, between September 2021 and April 2022.
Specifically, every time they were with the victim, “they called him dwarf, short, faggot and gay,” with the purpose of “annoying him” and without “knowing his sexual orientation.” And in addition, “they constantly hit him, slapping him and pushing him, every time they saw him,†both in the classrooms and in the center's sports facilities.
In April 2022, the child's mother brought these events to the attention of the educational center, which changed his class, but despite this they continued to bother him. Thus, on the 29th of that month, the defendants “intentionally hit him with a strong ball in the face and grabbed him by the arms and legs when he was on the school steps, lifting him up and then dropping him heavily.” on the ground, taking off a shoe with which they played soccer.â€
As a result of this, the minor was transferred by his mother to the Valdecilla Hospital, where no physical injuries were found, but due to the emotional suffering he was suffering he was referred to the Psychiatry service.
All of this constitutes, according to the sentence to which this agency has had access, a crime against moral integrity for which the four minors now convicted are responsible and who, through their lawyers, agreed with the facts considered proven. and with the measures requested by the prosecutor: socio-educational tasks for 10 months and 4,000 euros in compensation to the victim.
The measures imposed and accepted by the defendants are aimed, in one case, at maintaining their schooling and promoting their moral development and empathic capacity; in another, to develop their assertive social skills; in the third, to promote their moral development; and in the last one they are aimed at their training and socio-labor insertion, as well as the acquisition of social skills and to promote their empathic capacity.
