The judge has passport withdrawn to the fisherman’s boss Villa de PitanxoJuan Padín, after testifying as accused for his alleged responsibility in the sinking of the Galician ship on February 15 in the waters of Newfoundland (Canada), in which 21 sailors died.
The head of the Central Court of Instruction Number 2 has also imposed on Padín the obligation to appear every 15 days in court. Thus, the magistrate Ismael Moreno has agreed to what was requested by the Prosecutor’s Office, a request to which the families of the deceased have adhered, although some had also demanded house arrest.
Sources present in the statements have pointed out that Padín has been ratified in the version offered so far, that is, that around 04:00 the boat engine stopped, which, given the meteorological conditions existing at that time, caused the tragedy. In addition, he has specified that, when the time came, he gave the order for the entire crew to put on the survival suit, emphasizing that there was something for everyone.
Samuel Kwesi, one of the surviving sailors, recounted in his last version that there was no express order for them to put on the suits and that it caught his attention because the boss and his nephew, Eduardo Rial -the other survivor- did wear them. In this sense, Juan Padín has stated that, although it was everyone’s responsibility to put it on, the crew was in shock. For his part, the boss’s nephew, who has come as a witness, has supported his version, which coincides with his uncle’s.
According to the version given by Samuel Kwesi, the engine did not stop, but the winches that pick up the gear stopped working properly, tensioning but not picking up and causing the list. Therefore, they yelled at the captain to drop the gear, but he refused. Then, with the ship very tilted, the engine was stopped and the list to port increased.
This version of Kwesi corrected his first statement, with which he described that when the engine stopped the boat was left at the mercy of the waves, which, together with the weight of the rig, caused a lot of water to enter and list to port. Then, he heard the captain order them to get on the bridge, which he did without the survival suit for not giving him time.
