The Supreme Court dismisses the appeal of the General Council of Pharmacists (CGCOF), in line with the decision of the TSJUE: there will be a NodeSNS Farma The Contentious-Administrative Chamber of the Supreme Court has rejected the appeal that the General Council of Official Pharmacists Associations (CGCOF) filed against the creation of the NodeSNS Farma of the Ministry of Health in Royal Decree 7171/2019, a system of verification of medicines dispensed and financed by the National Health System.
It reaffirms what was stated in the judgment of January 26, 2023 of the CJEU, which already established:
• That the creation of NodoSNS Farma is not contrary to European regulations (specifically in accordance with Delegated Regulation 2016/161).
• That «the mere possibility that the establishment of a node can be decided through regulations in the event that the entity managing the national repository, on the one hand, and the public authorities, on the other, do not reach an agreement, cannot be contrary to Union law.
