Another 10 years in prison for an osteopath from Almería for sexual abuse of patients in his office

The Almería Court has sentenced an osteopath to ten years in prison for sexually abusing two patients who came to the consultation he had at his home in Níjar, suffering from different conditions, and the accused inserted his fingers into their genital area while They were lying on the stretcher, touches that he pointed out were “necessary to mitigate their pain.” The man was previously sentenced to five and a half years in prison for a crime of similar characteristics involving another woman.

On this occasion, the Third Section condemns the accused for two crimes of sexual abuse with the introduction of bodily members, although it acquits him of a crime of professional intrusion. The sentence, which can be appealed, also disqualifies the osteopath for a period of 12 years, seven years of removal and incommunication for each of the victims and six more years of supervised freedom. In addition, he must compensate them jointly with 10,000 euros.

The events took place between 2014 and 2015, when OFB treated the patients at their home. The first of the victims went to the clinic because he suffered from a back problem so, following the defendant’s instructions, he lay down on the stretcher, where “unexpectedly and without warning,” the man “began massaging his groin.” .

It was then that the accused, as was proven during the oral hearing, introduced his fingers into her genital area “in a surprising manner” while telling her that “he did it because an orgasm would help him relax.” Faced with this situation, the woman “immediately” got up from the stretcher, paid and left.

The second crime occurred months later, when another woman went to the clinic for problems with bladder spasms. After putting pressure on her abdomen and pelvis, the man “put his hand down her sweatpants,” pulled her underwear away from her and again performed “touches” inside her vagina. .

The court granted verisimilitude to the statements made by the victims due to their forcefulness and detail in the narration of the abuses of the accused, perpetrated with “lubricious spirit” and with “evident lewd content and sexual satisfaction.”

In both cases, “it encompassed the clear purpose of attacking the sexual freedom of the injured parties and achieving this by taking advantage of the situation in which he himself, abusing his professional status, had placed them by being left almost naked on the stretcher, subjected to the touching that he considered convenient under the excuse that they were necessary to alleviate his pain.

It should be noted that the accused was already sentenced by the same court to five and a half years in prison for similar events that occurred in August 2018, when he abused a woman who came to the consultation because she was suffering from a herniated disc. During her examination, which led to her abuse, the convicted man assured her that “her cervix was displaced” after inserting his fingers into her genital area.
