The judge prohibits Rubiales from approaching within 200 meters of Hermoso or communicating with her

The magistrate has refused, however, to impose on him the obligation to appear in court every fifteen days, as requested by the Prosecutor’s Office.

The judge of the National Court Francisco de Jorge has prohibited the former president of the Royal Spanish Football Federation Luis Rubiales from approaching Jenni Hermoso within a radius of 200 meters or communicating with her, during the investigation of the case opened by the kiss on the mouth that he gave to the player in the World Cup final.

The magistrate has partially responded to the request of the Prosecutor’s Office and the private accusation exercised by the soccer player and has agreed to these precautionary measures for Rubiales, after his declaration as under investigation this Friday for alleged sexual assault and coercion of Hermoso.

After his statement at the National Court, just five days after resigning, the Prosecutor’s Office had requested that a restraining order be issued against him less than 500 meters from Hermoso, a distance that the judge has shortened by decreeing the prohibition of Rubiales approaches the soccer player within a radius of 200 meters.

In an order, which has not been provided to the media, the magistrate has, however, refused to impose the obligation to appear in court every fifteen days, as requested by the Prosecutor’s Office; and he has also declined the request of Jenni Hermoso’s lawyer to seize her assets preventively.

As expected, the former president of the RFEF has maintained that that kiss was consented to by both parties, as he already defended before the General Assembly of the institution; and he has denied that he coerced Jenni Hermoso or her entourage to publicly justify that episode, as reported by sources present in his statement.

Rubiales’ appearance lasted barely an hour, in which he answered the questions of the judge and all the parties and maintained an exculpatory version by denying all the accusations directed against him by the Prosecutor’s Office, which filed a complaint after Jenni Hermoso formalized her complaint.

For her part, the world champion’s lawyer, Carla Vall, has reiterated that, as Jenni Hermoso already stated, “it was a non-consensual kiss.” “Everyone saw the images, the entire country saw them. And we can say precisely that thanks to this, thanks also to social change, to legal change, in some way we can maintain that there was a complete lack of consent on the part of Mr. Rubiales “, he stated in statements to the hundred journalists gathered before the National Court.
