EH Bildu understands that it is necessary to prepare a third “impartial expert report” different from the two presented in the case by the parties, with the intention of clarifying “the million-dollar extra cost left by the liquidation” of these works.
EH Bildu has announced that it will appeal to the Court of Gipuzkoa the filing of one of the two complaints of the so-called Bidegi case by the court investigating the case, at the same time that it will request that an “impartial” expert report be carried out to “clarify the truth”.
The spokesperson for EH Bildu in the Road Infrastructure Commission of the General Councils (JJGG) of Gipuzkoa, Oskar Bordes, has made this announcement after a week ago the Court of Instruction number 2 of Azpeitia provisionally filed one of the two complaints of those in the case.
Both were presented by the Provincial Council of Gipuzkoa, when it was governed by EH Bildu, for misappropriation of public funds and falsification of documents related to the construction of the AP-1 highway, and refer to the actions of the previous executive, chaired by Markel Olano. (PNV) between 2007 and 2011.
The first of them, which is still in the investigation phase, is related to a deposit of leftovers, excavations and earthworks in a section (Eskoriatza Norte-Arrasate Norte) of the AP-1, in which the prosecution calculated an alleged fraud of 13.6 million euros.
Subsequently, the Provincial Council filed a second complaint for alleged embezzlement of public funds of 17.1 million euros and an alleged crime of document falsification in payments for the Isuskitza tunnel work, which is the one that has now been archived.

“At EH Bildu we believe that the judge has waived certain procedures, including the request and presentation of a third impartial expert report, in addition to the reports issued by the parties,” explained the leader of EH Bildu.
“This is precisely what the Prosecutor’s Office has demanded throughout this entire process,” insisted Bordes, who recalled how the Public Ministry presented a document on July 2, 2021 in which it stressed the “extreme complexity and technicality ” of the case and requested that “an independent expert test be carried out to clarify the reality of the facts.”
In his opinion, this independent report would allow “to determine whether an irregular payment was made to the construction companies”, given that, also according to the Prosecutor’s Office, “the expert reports of the parties in conflict presented absolute contradictions.”
