The Provincial Court of Almería has sentenced the Moroccan immigrant who a popular jury found guilty of breaking into his ex-partner’s house to threaten her and attack her with a large knife to sentences totaling four years and ten months in prison. The woman was accompanied by a couple of friends and her teenage daughter, who took refuge in one of the bedrooms. Seeing that the victim did not open it, she broke down the door of the house and forcibly entered the house “in a threatening manner.” Once inside, he went to the kitchen, grabbed a 32-centimetre kitchen knife and walked towards the woman with the intention of intimidating her.
While she was in the grip of “great fear and anxiety”, she rushed at the victim and pushed her against a piece of furniture, which caused her to hit her shoulder and suffer minor injuries – the only extreme that did not have the unanimity of the jury and which was supported by a majority of eight votes.
For the events reported, he has been sentenced to two years and eight months in prison and to pay a fine for the crime of breaking and entering with the use of violence, in which the aggravating circumstance of kinship occurs and which also entails a restraining order. 500 meters from his ex-partner for five years. In addition, he is sentenced to one year and four months in prison and another restraining order of 500 meters for five years for a crime of unconditional threats, as well as a fine for a crime of damage.
