Two local police officers from Marbella, in Malaga, have been provisionally sent to prison after being arrested for an alleged sexual assault on two migrant women. The agents identified the two young women, who are in an irregular administrative situation in Spain, during their working hours. And hours later, already off duty, was when they allegedly committed the attack. The men are being investigated for sexual assault, bribery, crimes against privacy and negotiations prohibited to public officials, according to sources from the Superior Court of Justice of Andalusia (TSJA) explained this Monday. Both will also be suspended from employment and salary, according to police sources. Last summer, two other policemen who had raped an 18-year-old girl in Estepona managed to avoid jail after reaching an agreement with the Prosecutor’s Office and the victim.

The events occurred on July 12 in Marbella, although the victims did not report it until the 31st of the same month. As they explained, the agents were on civilian duty during the early morning of that day, when they approached the two women to identify them. Both are around 20 years old, are migrants and are in an irregular administrative situation. Hours later, according to the complaint, the four went to a remote area of the Marbella town where the police assaulted the women, as SUR has advanced, which states that at that moment the police couple was already outside. of service.
The women filed a complaint a little over two weeks after what happened. One of them was carried out in Estepona and the other in Madrid, although the investigation was carried out in Marbella —by the Family and Women’s Care Unit (UFAM) of the Marbella National Police— as that was the municipality in which events took place. The victims assured that they felt coerced into having sexual relations due to their administrative situation so that the agents would not report them. The investigation is supported, according to sources in the case, by an audio that the two women attached to the complaint and that comes from the mobile phone recorder of one of them, which was kept active to record all conversations with the agents. These, after being arrested, assured during the police interrogation —developed last Saturday, August 5— that the relations were consented. Next, the Investigating Court number 5 of Marbella ordered the entry into provisional prison, communicated and without bail of the two policemen, who are being investigated for the alleged crimes of sexual assault, bribery, against privacy and negotiations prohibited to officials public. Police sources have explained that the Marbella Local Police has taken disciplinary measures against both and that it has initiated a disciplinary file to, for the moment, suspend them from employment and salary.
The Minister of Social Inclusion, Youth, Families and Equality of the Junta de Andalucía, Loles López, has expressed this Monday the “rejection” of the Government and “Andalusian society” at the alleged aggression, according to Europa Press. “I don’t know how it will develop judicially, but of course the full weight of justice falls and the facts are clarified”, López requested from Almería, where he participated in a distribution of informative material within the campaign for the prevention of violence in Andalusia promoted by the Andalusian Women’s Institute (IAM).
Last year, two other local police officers, in this case from Estepona —a neighboring municipality of Marbella— were sentenced to two years in prison for a crime against sexual freedom after considering that both, dressed in uniform, raped a 18-year-old girl whose vehicle had been stopped minutes earlier. The sentence reflected that one of them inserted several fingers into her vagina and the other penetrated her without her consent. The Provincial Court of Malaga, however, suspended the sentence after the parties reached an agreement prior to the trial. The agents, who recognized the proven facts in order to reach the pact, promised not to commit any crime again in a period of three years and to participate in a sex education course.
