The Court of Seville plans to constitute this Tuesday the popular jury of the judgment promoted against the former director of the Andalusian Foundation Training and Employment Fund (Faff), Fernando Villento squander on brothels the money of the Andalusian unemployed. The former high office of the Socialist Junta spent 32,566 euros in alternate clubs, 15,000 euros of them in just two days. The lawsuit is also directed against Ana Valls, former financial economic director of the aforementioned public entity. The sessions will start, remember, next Monday May 29, one day after the municipal elections. The Prosecutor’s Office requests six years in prison for Villén and four for Valls.
Initially, the Court of Seville had decided to celebrate this trial, presided over by Judge Mercedes Alayainitial instructor of the macrocause of ERE, between May 18 and 26, before the 28M elections. However, the Court finally agreed to the request of the defenses of the two defendants to set a new appointment on dates unrelated to the electoral periodopting for the constitution of the popular jury this Tuesday, so that the first session as such is held on Monday, May 29, the day after the voting.
Precisely in May, but in 2022, the Seville Court appointed Judge Alaya, currently in the Seventh Section of said instance, as the presiding magistrate of the court in charge of this popular jury trial, which is directed against the former director of the Faffe , Fernando Villenand the former financial economic director of the entity, Ana Vallsfor an alleged continued crime of malpractice of public funds, in competition with a continuous crime of falsehood in official document committed by a public official.
“Illegal” disposition of funds
In the order to open the oral trial against them, issued in April 2022 by the reinforcement judge of Instruction No. 6, José Ignacio Vilaplana, the magistrate recounts that Fernando Villén, “taking advantage of his position as technical director” of the Faffe, “I would have been carrying out, continuously, a illicit disposition of funds of said public entity, diverting them from their own purpose -which is none other than the promotion and financing of activities related to the training of the unemployed-, using them to pay for the services received in different local alternates of Seville and other Andalusian provinces that he frequented, using the Bank cards that he had (in total, three cards out of the six that he had as director) against the accounts of the aforementioned Foundation».
The judge points out that, in total, this defendant “would have spent through the use of the Faffe bank cards a total of 32,566 euros in prostitution premisesexpenses paid from Faffe funds”, adding that, “in order to hide the illegal provision of public funds”, the person under investigation, “in collusion” with the Faffe’s financial director between 2004 and 2011, “they would have devised a system by which the reimbursements of the aforementioned charges made by the accused were simulated”, in such a way that, “in the Daily Books of the Faffe, there are entries for the return of the aforementioned amounts that do not correspond to reality ».

In this sense, the magistrate states that, “for this purpose, that is, for the purpose of simulate the return to the coffers of the Faffe of the amounts illegally disposed of by its director, the defendants would have used the box of the Faffe’s Economic and Financial Directorate, simulating supposed -in reality, non-existent- replacements in cash (thus avoiding the use of bank transfers or a similar method) of those provisions illicit, thus causing the expenses to be camouflaged as income in the Central Fund, for their subsequent inclusion as such in the accounting”.
«In this way, a few days after registering the use of the cards in this type of premises, they are located, in the corresponding Faffe Daily Booksdifferent entries in which there is an accounting return of the charges made in the Cash of the General Directorate of the Faffe for the exact amount provided, reflecting for this type of notes the concepts of income FV and return Visa FV “, according to the judge in the car.
The judge analyzes in the order each one of the operations carried out, as well as, where appropriate, the corresponding justification and accounting entry thereof, and points out that the defendant “could have carried out or omitted acts tending, either to cooperate, or to cover up the illicit disposition of public funds that would have been carried out” by the other investigated, “thus being able to have participated in the preparation, use or handling of documentation commercial or accounting, with the purpose of simulating the return of funds illegally used, as well as allowing the use of the Faffe’s own money” so that the accused “carry out the -in such a case, supposedly- refund of those funds” .
In line, it points out that the defendant, “as financial economic director of the Faffe, would have held the highest responsibility in the management, replacement, operation and control of the funds and boxes of the Foundation, in particular, of the Central Box of the General Directorate itself, through which the criminal mechanics denounced”.
For all these reasons, the judge agrees to order the opening of an oral trial against the two investigated for an alleged continued crime of embezzlement in a media contest with a continued crime of forgery in an official document committed by a public official -without prejudice to the final legal classification that may be attributed to them in final conclusions.
The Prosecutor’s Office requests six years for Villén
The Special Prosecutor’s Office against Corruption and Organized Crime, in view of the aforementioned trial, requests six years in prisonl for Fernando Villén and four for Ana Valls.
