The man accused of killing his sentimental partner on December 3, 2021 in his apartment on Conde Altea street in Valencia has admitted the facts before the people’s court that is trying him on Monday but has assured that he did it at a time of “obstinacy ” before the obsessive idea that she was going to leave him.
The defendant had a relationship with the victim for three months before the crime, although they did not live together.
On December 2, 2021, the defendant and his partner met in his apartment, had dinner, watched a series and went to bed, where they had sex, according to the prosecutor’s account, which explains that the woman later took a benzodiazepine that he had prescribed for anxiety problems.
Around 3 a.m. the following day, the defendant, who suffered from insomnia, “began to think about how to end the life of his partner, a thought he had already had days before, because he believed that she was going to leave him.”
“With complete coolness, he picked up a stone that was in one of the flowerpots on the terrace and hit the victim several times on the head and face, which left her unconscious.”
In addition, he stabbed her in the chest several times and strangled her with the belt of a gown, so that the woman died of hemorrhagic hypovolemic shock with added suffocation.
“After verifying that his partner had died, he showered and put on pajama pants, and went to an interior terrace, from where he fell onto the uralite roof of a restaurant warehouse located on the ground floor of the building,” he explains. the Public Ministry.
Inside, “the defendant consumed various products and drinks and made two calls to 112 from the restaurant’s landline after 7:20 a.m., and was discovered by the local cook, who called the police. The accused led the agents to believe that he had entered to steal.
It was the victim’s sister who reported him missing on December 4. Her telephone number was located at the defendant’s house, so the defendant’s father and brother and the mother and a cousin of the deceased went there.
The woman’s body, always according to the prosecutor’s account, was found with a knife stuck in her temple.
The prosecutor’s qualification details that there are no physical, psychological or toxicological evidence that the defendant had acted under the influence of alcohol or other drugs, nor that he suffers from any mental pathology. Specialists only refer to antisocial personality traits, without there being a psychopathological basis to determine that this has led to a personality disorder.
On the contrary, forensics consider that at the time of the facts the defendant had the capacity to know and act with knowledge.
For all this, the prosecutor demands a sentence of 25 years in prison and the payment of compensation of 90,000 euros to the mother and sister of the deceased.
The defendant’s defense has admitted that a murder took place, although he has asked the court to consider that the events occurred in a process of “obstinacy” or temporary mental disorder, for which he claims a reduction of the sentence to 10 years.
As the defense lawyer has assured, the perpetrator of the crime thought that his partner was going to leave him, an “obsessive idea” that exploded into a crime that was not prepared, as evidenced by the accident on the run.
The defense does not demand acquittal, but “justice”, and has insisted that his client is extremely sorry for having attempted suicide.
The private prosecution and the prosecutor, on the contrary, have underlined the cruelty with which the crime was committed and are demanding a 25-year sentence, with the aggravating circumstance of gender in the case of the prosecution.
